Legal options

It is always advisable to seek legal advice before taking legal action.

Sexual harassment on the internet, especially through the unsolicited sending and forwarding of pornographic content, constitutes a serious offence. Sending such content without consent can, in many cases, be punishable.

What is punishable by law?

  • Unsolicited sending of images of genitals
  • Pornographic images accompanied by harassing requests
  • Sending images of sexualised violence against children and adolescents.

Legal bases

  • §184 of the German Criminal Code (StGB) The distribution of pornographic content to persons under the age of 18 is punishable by law.
  • §240 StGB Sending such content may be considered coercion
  • §184b StGB The possession, acquisition or distribution of so-called child pornography content is a criminal offence.
  • §185 StGB insult
  • §176a para. 1 no. 3 StGB sexual abuse
  • §4 GewSchG (Protection Against Violence Act) violation against a Protection Against Violence Order

Civil remedies

Those affected can also defend themselves under civil law, for example through warnings, injunctions, or a temporary restraining order. Here, too, we recommend seeking prior legal advice.
